I had filed my income tax for FY 2012-13 properly on July 30 2013 and also got a response. At that time, I had owed some taxes which were properly paid. For reasons that I do not understand , my tax consultant filed the taxes again in Janury 2014. This time of course , no taxes were paid by me because I didn't owe any.
The income tax department then sent a notice to me. In that notice, it was assumed that the FIRST time the taxes were filed was in January 2014. And that the FIRST time the taxes was paid was in January 2014 (I had paid that in July 2013 as stated above).
Now they want me to pay the interest on the taxes owed from July 30 2013 to January 2014. My tax consultant filed a rectification request. The income tax department responded by sending the same letter. They added more penalty as the duration had increased. Now my tax consultant has given up.
I am being made liable for a hefty amount for no reason. I have al etter prepared to explain to income tax authorities the faux paus but I doubt anyone is going to take a look at that. What else can I do.
For reasons that I don't understand, the jurisdiction of my income tax return is at my birthplace which I left 20 years ago and no longer visit. So it will be difficult for me to go and try to meet someone in person.
But if push comes to shove, I am willing to go there. Please advise if there is any way to deal with this

Did the tax consultant offer any further understandable explanations for this January 2014 filing ? The "has given up" means the tax-consultant had washed the hands off of your affairs ? And you are left holding the invoice for the penalty ?
You can pay the penalty and then continue the struggle to get it back. This way your interest penalty would not keep growing... and when it is really big, and lots of time had elapsed, any spurious judgement against you would cost you plenty more.
Perhaps you will get a new consultant who will fix your jurisdiction issue, as well as manage to subtract all these overpayments from your future obligations.

Have you checked "know your assessing officer" on e-filing web site?
1. Check jurisdictional officer based on your primary residence PIN. You should be able to find AO office address from web.
2. Go and meet the officer and request that PAN be transferred from your native to place to your usual residence.
3. Go through Assessment order issued under sec 143(1).. mark/identify where exactly is the short-payment being shown.
4. They may have missed your payments, then its easy to rectify.
5. If amount disputed is substantial - pay first and then ask for refund.

post_r2i06 - the officer is in my earlier home town which I left a decade ago. That is the reason why I am not able to go - I talked to a consultant there and he said it is not easy to meet the IT officer there. So I am stuck.
okonomi - the tax consultant has washed his hands off completely. There is no way to get anything against him now - when I filed taxes (in fact with any consultant that I have come across - they will not put their name on income tax - I was told that this is 'ok' but now I understnad why it is not). I am still trying to figure out how to get the penalty back once I paid it up

In my own case - my PIN code falls under one office and according to online site my PAN is under another AO.. they made me run around both offices(they both are in Bangalore - 8 kms apart), finally they have accepted application.. not sure if they will act on it or not!

All income tax issues and Audit are closed by paying bribe to the IT officials. So why why would someone loose the opportunity ?. No matter how much details you provide you will made to run all over the place until you get into a deal.
Typical real cases ( from people I personally know) You have a pay a certain sum as cash depending on the tax issues. Second arrange for a vacation to the IT officials family with transport provided from home. All booking provided by in the name of the individual and not the IT officials. These IT officials crook think by not making booking in their name they escape.
I keep telling my known people, in addition to settling make effort to discreetly capture the IT guys movement in that resort/city and post in FB.
The ordinaly tax paying ciitzen is questioned for every dime but these IT officials , we need to question the source of income for their vacation ?. With Social media we need to expose these people.
