Is a down payment(say 5% of property price)to a first time home purchase a qualified acquisition cost?

I withdrew 10K + 10k from my and spouse's IRA's. The purpose was for first home purchase in USA. The closing costs was around 4k. I used the 20k within the 120 days. Will I have to pay any early withdrawal penalty. I paid 4k(closing cost) + 32k as downpayment for the house.

I worked in US for 6 months last year by myself while spouse and kids were in India. Can I file MFJ for the last year. Family(wife and kids) moved to India 4 years ago. Last year worked on L1 for around 6 months.
