Hello Everyone,
I need a suggestion from you. I am 33yrs old male, planning to r2i after my USC comes through. I am eligible to file it any time but my marriage is on rocks now and I am separated from my wife. On thinking upon saving it, I just feel helpless so have decided to let go my spouse for her as well as my own good.
I was going through N400(citizenship form) and it asks about my marriage status and info about spouse. I am in dilemma which process should I file first - Divorce or USC ?

If I file for USC first, I will need to provide my spouse information and my marital status. If I say that I am married and fill a separate address of my spouse, it will be very misleading. Also, there is no box which allows me to select my marital status as 'separated'.

I am really confused and want to seek advice from all of you.

If you are still married, it should not matter that you have separate addresses. I would say get the USC application going and figure out the other stuff later.

I don't think it will create any confusion if you say that you are married. At the same time if you give a diff spouse address it won't be misleading. It is quite common in the US than in India. You are legally Married until you are officially divorced and there is nothing in between . Anyway just for your piece of mind call an Attorney and find out. You can even try to email Rajiv Khanna or Sheela Murthy.

Who knows one day you might get back togeather.
