OCI/PIO/Indian Passport??

Post by singhisking »

:confused::confused::confused:
I am going nuts, I have read so much but could not make a conclusion. Could Gurus please help.
Basically I've newborn in USA, we both Indian citizen.
Now, because of weird/crazy law, new born cannot get OCI if parents Indian citizen.
So now what to do?
Shall I apply for Indian Passport for the new born? I'll be making frequent trips to-and-fro.
Or shall I go for PIO?
Can new born get OCI by any means.
Please help.

If your child was born in USA then s/he becomes a US citizen by default. I am not sure which law you saw that a new born cannot get OCI. If one of the applicant's parents or grandparents was a citizen of India after January 26, 1950, then the applicant is qualified for OCI. You can go for PIO, the eligibility is 15 years, whereas OCI is lifelong.

Go to Indian consulate website, it states one of the parents needs to be US citizen to get OCI.
It is very absurd, totally non-sense. people who need it most won't get it.
Gurus please help.

But I have heard some clever minds have secured OCI, is there any way?
I wanted to get OCI for my kid instead of PIO.
Do you know the logic behind not allowing OCI for kids born to Indian parents but to US citizens? Are they telling parents to get US citizenship then only you are going to get special treatment?

Those cleaver minds might have recieved OCI when it was initially started.

When OCI was started, a child could get OCI even if parents were Indian Citizens.. However, later they changed the clause. "A minor can not get an OCI if both the parents are still Indian Citizens".

1. I do not understand the logic

2 the use of word "still" is surprising. Seems like Indian citizenship is inferior to USA. If you are "still" Indian citizens.... then....

From Indian Embassy website:

2. Who is not eligible?
* Foreign-born minor children are not eligible for OCI if both the parents are Indian citizens holding Indian Passports

There is no "still"

The rationale is, if at least one of the parents is eligible for OCI, then the minor child is also eligible.

This is what is on the website
"Children born outside India and whose parents are Indian passport holders are not eligible for OCI Cards."

I think there is a big communication gap somewhere due to which they are not granting OCI for kids born outside to Indian citizen parents. Initially it was allowed but later they changed the system.
I won't be surprises if they change the system if people start appealing.
Unless some guru is ready to give explanation on this forum.
I tried calling them, they either don't pick nor ready to talk.
