Need help on Visa convertion(T to X) and apply PIO card in India

My son is US Citizen and he is 6 years old (DOB - 25 March 2005), both I and my wife are Indian Citizens. We came to India in March 2007 and due to personal reasons we haven?t gone back to US and settled in India. My son is on ?T? Visa, we have taken permission from local FRRO for his stay and his stay is expired in April 2010 and once again we have applied for permission but hasn?t get any update from the FRRO. I have applied for PIO card once in 2009, but unfortunately they sent back a letter saying that they cannot issue a PIO card if he is on ?T? Visa and asked to convert it to ?X? visa.
Could you please help us in either converting the Visa type or getting PIO card for my son, we may not go to US in near future.

or

Is it better to cross the border going to Srilanka or Nepal to get it converted or
is there any way that we can convert the visa here in India it self.

Can any one please help on this. we have been just extending the permission with the local SP. We stay in Hyderabad.

First- It is good to start this below process within 6 months after you enter India. Mostly people of outside Delhi get the police commission's office or local FRO and get extended stay of 2-5 yrs for the child by getting a seal on the foreign passport. This will not help you after 5 yrs and you have got thru below process after tht. no option.
Second - try to get PIO asap because visa extn for every year is a pain. same process each year.

to convert visa 'X' to 'T', you need to go MHA(Ministry of Home Affairs) in New Delhi. Get the address and other details about MHA from official website: http://MHA.nic.in

1. MHA gives permission only for Visa conversion and extension (for abt 1 yr). Take all documents of parent and kids (all passports, child birth cert., parent resident proff) to MHA.
Timings: Mon to Fri & entry time between 10AM to 12Noon. It is full one day process in MHA. Reach there at 10AM at the MHA reception and they give token to get into the MHA building. Which room to go is all mentioned on that token. Fill the required form which u get inside the room and checkbox the Visa convert (X to T) and Visa extension for 1 yr.(apply for both) and submit it back to same desk. Your Child's name & country will be called by officer and you show all docs to him who will accepts the application form. They take all applications and distribute the permission envelope on the same evening around 5-6PM which is the addressed to your regional FRO. DONOT open it. You are just a Postman to take it the addressed FRO. If you open it, permission becomes invalid.
2. FRO/FRRO will only open this envelope and register you there. They will now be able to convert & extend child visa. Then again register yuself in same FRO as 1 year Visa type X. You can now apply for PIO will required documents (docs are almost same as above point 1 & FRO registered copy of point 2)
3. After you get PIO (in 3 to 6 months time), you have to again register in same FRO as PIO(special visa of 15 yrs) so that immigration dept knows that your child is valid to stay in India for next 15 yrs. NOW you are free for next 15 yrs.
Note:
1. In these 15 yrs of PIO the child goes out of India visit, you need to simply register again in local FRO within 6 months (whole process of MHA or PIO not required) after comming back to India that you are going to stay in India for more than 6 months.
3. FRO/FRRO registeration means telling the govt that foreigner is residing in India at specified address with valid visa.
2. You may apply for OCI (lifetime valid to stay in India) only if one parent (not both) is indian citizen OR child is atleast 18 yrs old.
3. OCI is definately better than PIO. Apply it when he is 18yrs.
4. Don't panic or scared of going to FRO/MHA even it is more than 6 months after entering India. There will be just a penalty amount for this and yu child will be able to stay with you, here in India.

Hi Thanks for the post. I missed registering my kid (she is on T Visa) and I was told to goto Delhi. DO I need to take my kid also to Delhi or as a parent I can go and apply for conversion of visa from t to X?

Only one change: They have changed process now that no more letter handling. MHA sends email notification to the respective FRRO and give you an unique id on the spot. You don't need to come back at 5 pm to MHA. You are free to leave after you got the unique id.
