Only OCI card needed?

Hello,

I am currently on H1B visa, green card application on file but do not have priority date. My wife has H4 visa. My 1.5 year old son is US citizen. He has US passport. We are considering going back to India next summer permanently. Is OCI card all that we need for my son to go back or do we need to get something else as well? Any good website with guidance for applying for OCI card?

OCI Card is the only required thing which they see at the immigration counter. You will be fine.

So does it mean you still havent got the OCi for your son. Depending on where you live check on the indian consulate website and apply. I think now they have all given to VFS to process the applications. We got ours in a month or so.

Check CKGS website. You can call them too. you need usa birth certificate and usa passport of your kid and all other documents. Many papers and notarize and photo all those you need. Check their website and call them about your questions

There is no problem if you havent got it, you can apply anytime to get the OCI. Make sure you apply well before you travel just in case any delays. After all you are dealing with VFS which pass on the info to consulate if i m right.

You haven't quoted yourself and ur wife current nationality . i assume it is indian for both (dad and mom).


I suggest you to apply for OCI card for ur son (USC) at USA immediately. it may take 90 to 120 days for oci card to process as it centralized at delhi.


Suggest you to apply for original certified copy of ur son birth record (around 20 #s). in india,if u take xerox it may appear as voided (depends on the state).


ensure u lock ur ssn credit report for certain period or use credit karma to monitor every month.
Irrespective of ur nationality or visa status, based on ur SSN, monitor ur federal tax returns every year being reported by USA based financial companies. ur are liable to pay ur federal taxes or dues if u owe anything and it is irrespective or ur nationality or USA based visa status.


assume u return to india by may 2019, stay at india for a year and by 02-04-2020 you can apply
a.) aadhaar car for urself, ur wife and ur USC son.


since he is just 1.5 years old, I Suggest, post getting new USA passport for ur son at his age 6 (around 2023), based on the stay of ur residence state , you can apply at local DSP office, for issuance of new oci card with new USA passport # reflected along change of address with the indian address stay by paying INR 15000.
while applying for education at india, u quote ur sons nationality as USA in the appln form.


In india , karnataka (KA) is leading with legal fight for long term USC with USA passport along with OCI card and domicile of KA state for more than 6 years of education (within KA state in approved schools), to be treated on par with indian nationals in all aspects.


In tamilnadu, based on the satisfactory of domicile stay (i.e study of education in approved schools within tamilnadu since his 6th standard) along with USA passport, OCI card and XII (based on CBSE or TN state board) along with NEET score , ur son is eligible for medical seat under OC category.


But not for govt sponsored TNEA admission for engg category.
In karnataka state it is different. Maharastra state it is different.


Post his XII education, certain indian uty (deemed) like VIT vellore/chennai, crescent chennai , Sastra tanjore, amrita - coimbatore
treat any students who studied at india in his XII on par with other indian national students and the fees are of same as indian nationals.
SRM uty at chennai charge 70% of NRI fees for any kid who did his XII at india and is foreign national bearing non indian passport along with OCI/PIO card


We parents (myself and my wife) are indian citizen.


My son is a USC and having OCI card and staying with me at india since 2003 and did his entire schooling education at Tamilnadu and now doing his B.Tech I.T. second year at local uty at chennai.


Post his attaining his 18 years of completion, I have helped him to get
a) pan card quoting (using form 49AA ) as USA nationality
b) India driving license (state of tamilnadu) with nationality as USA quoted in his driving license
c) aadhaar card with nationality as USA
d) have Opened bank savings a/c with nationality as USA and as resident indian (indian nature with OCI card and USA passport)
e) many indian national banks give educational loans only for indian nationals .
f) only one national bank i.e bank of baroda provide educational loan to resident indian .
pl. note indian national is different, resident indian is different (i.e any nationality along with OCI card or PIO card along with stay at india for more than 365 days in the past financial year along with meeting respective bank KYC satisfactory condition ).

to note, my son (USC) landed at india with T visa.
during 2003, post completion of 180 days at india, registered his stay at local FRRO office.
during 2010, residing within india, converted his T visa to X visa by paying rs 7500.
later residing within india, using X visa converted to PIO card and registered at local FRRO office.

later residing within india, During 2015 converted my sons PIO card to be as OCI card.

Thanks for the information about higher education process for OCI in TN. Could you please make a post on NEET and JEE admission requirements for OCI. If the OCI student studying in TN did not get medical seat thru NEET OC quota, can he apply to private medical seat. Will he be considered as NRI or resident indian.
Please share your knowledge about medical/IIT admission for OCI students in India. Please create a thread if you think the post does not belong here.

You need to get OCI renewed for every 5 years after your kid got his/her usa passport is renewed until 21 years old. i guess USA passport can be renewed in India through their embassy.

- not really to get the oci card renewed every 5 years compulsory. just active foreign passport along with OCI card and U visa stickered passport (old or new) is fine unless situation is warranted . each time cost is inr 15000.

Post his /her 17 years, better to have oci card revalidated or renewed or change of address performed with indian address tagged in the address column along with usa or foreign passport
