Surrendering the flat and stuck money

Hi All,
I need some specific advice on the real estate matter. I purchased a flat in Gurgaon in 2013 in my name, when I was in India. Original cost of flat was Rs 45 Lakhs. After payments of Rs 16 Lakhs, I decided to surrender the flat due to various reasons in 2015. I came to USA towards end of 2014. I requested the builder to transfer the flat in my parents name. Flat was bought through a property agent. It has been 2+ years since I surrendered the flat (will be 3 years in another 3-4 months), I have not received the money back. I and my parents have spoken to my agent almost on a monthly basis for last 2 years, but no money has been returned so far. I was told that after deducting the penalty roughly 13 Lakhs will be returned. Builder says that they have to register the society under RERA, he can not return the money till registration formalities are completed. I exerted more pressure on the agent to get the money back, but to no avail. Agent tells me that once RERA formalities are completed, money will be returned. I have been hearing the RERA registration excuse for last 6 months.

Please advise what action can I take on my end to expedite the retrieval of monies or recommendation is to wait more as registration may infact be taking longer. Thanks much for the inputs!!

No responses..surprising!
Anyways after exerting pressure with the agent, he threatened the builder to file a complaint with RERA. Agent promised to get the money back in a month..
Its wait and watch for now..

Its wait and watch for now..


Not sure why you had to pay the agent instead of the builder. There is a possibility that the agent might be fooling you. Did you contact the builder directly?

By now the builder should be registered with RERA, the deadline was somewhere in the middle of the last year and most of them got registered with RERA. Who is the builder if you can share the name, I will see if I can find something? Share the agent name too if comfortable.

hermes, money was paid to the builder. Though checks were dropped at the agent office. I never spoke to the builder directly.

I guess my PM access may start after I post some minimum number of messages. Nimai is not very known in Gurgaon (few agents I spoke to were not aware). I believe it has more projects in Rajasthan (Bhiwadi etc).

Couldn't find any info about their RERA registration (it seems they may have not done the registration yet).

Here is Haryana RERA website which is not functional yet but am hearing should go live in next few weeks http://www.harera.in/
