Hi,
I'm a US citizen and OCI. I have returned to India few years ago and I'm now a resident for Indian tax purposes. My dilemma is regarding the tax status in US. Am I to be considered as a resident and file 1040 or am I to be considered as a non-resident American? If I'm an NRA, which form should I file for income tax returns? I have no income in the US now and present in US less than 30 days.
As I was going through some IRS forms, I came to understand that if one is considered as a resident in a tax-treaty country, that person can be treated as a non-resident in US. So, what form should I file (1040NR)?

Since you are USC, you will are resident for the tax purposes. Hence you need to file Form 1040 reporting your global income. Taxes paid in countries where US has a tax treaty you will be allowed credit in the US per the tax treaty clause.
