Using the attached file one can know their RNOR status. Knowing this in advance helps in financial and tax planning.

Dear Sohu,
1. Having looked into the calculator I draw attention to the error re: residential status in the example - Year 1 being the year of return to India.
.02 If the returnee NRI's stay in India in the Financial Year of return does not exceed 181 days but stay does exceed 59 days and more over if the stay in immediate preceding 4 years also totals to 365 days or more than he will be treated as a Resident and not a Non Resident.

2. This is important as after return both conditions will apply unlike the case of an NRI visiting India wherein sole criteria is stay exceeding 181 days only will apply.

Basic Conditions for a Resident
[LIST=1]
  • In India for 182 days or more during previous year
    OR
  • In India for 60 days or more during previous year (AND)
    365 days or more during 4 preceding previous years.[/LIST]Exceptions :
    [LIST=1]
  • A citizen, who leaves India in any year for employment, is not treated as resident in that year, unless he has been in India for 182 days or more.
  • An Indian citizen or a person of Indian origin, who is abroad, comes on a visit to India, in the previous year, the pe-riod of 60 days [(in (2) above)] is extended to 182 days.[/LIST]Additional Conditions
    [LIST=1]
  • Resident in India in at least 9 out of 10 previous years preceding the previous year
    AND
  • In India for 730 days or more during 7 years. preceding the previous year.[/LIST]Resident and ordinarily resident - If the Individual satisfies any of the Basic conditions and both the Additional conditions.
    Resident but not ordinarily resident - If Individual satisfies either of the Basic conditions, but does not satisfy both any of the additional conditions. Non-resident - If individual does not satisfy any of the Basic conditions.

    Year means Indian financial year : April to March

    I think there is a mistake in calculating 730 days in "Resident Status" sheet. I think the rule is to calculate 730 days in India in the 7 previous year preceding the year in consideration. In "Resident Status" sheet, cell J7 = F7 - G7.
    Here cell F7 calculates total days in India in 7 previous year preceding the FY in cell C7, but G7 is the number of days outside India in FY in cell C7. I think G7 should not be subtracted from F7.

    Similarly, in the subsequent rows G8, G9 etc should not be subtracted.

    Am I missing anything here ?

    Yes, RNOR definition relies on days spent in India in the 7 years preceding the year in consideration.

    Yes, column G which refers to number of days outside India in the year in consideration, shd not influence the above calculation.

    How does one establish RNOR Status, assuming you are eligible for it.
    Open a bank account or apply to RBI?

    No need for those. Just claim RNOR status in tax return, and if needed, attach copies of relevant pages of passport that show entry and exit dates from India.

    Is there a new spreadsheet with the fixes you mentioned in this thread? I am trying to find the magic date which gives me an additional year of RNOR.

    I played with RNOR Status Calc v3.xls by Sohu in the first post.

    My case:
    Departure from India:3/15/1999
    Date landed in India --- Date departed from India --- Days in India (during a FY)
    1/27/2002 --- 3/3/2002 --- 36
    12/29/2002 --- 1/25/2003 --- 28
    12/28/2003 --- 1/24/2004 --- 28
    02/19/2006 --- 3/12/2006 --- 22

    Optimal dates to R2I for 3 years of RNOR
    In year 2009, 4/23/2009 or later
    In 2008, 5/21/2008 or later

    Assuming no visits outside India after R2I.

    I am thinking that the fixes mentioned in this thread doesn't affect my case and the dates are probably good. Please let me know if I am thinking right or if there are any errors in my computation.
