Do I need to Inform INS/CIS before R2I

Post by r2ikyon »

I was on H1B at the time of returning to India (2 months back). Was/Is there a need to inform INS/CIS about my moving out of country? I went through R2I check list on this forum and the ones listed by RRK but did not find anything.

The reason I ask this is "If I wish to work in US say, after 1 year of stay in India will I be eligible to work on H1B for 6 years again? Will they look at the date I left the country stamped in my passport or will they need a copy of any specific document ( required to be filed by me with INS at the time of leaving US) as a proof to show that I stayed out of the country for 1 year?

Can some one please let me know?
Thx

To my understanding, you will be eligible for getting H1B again if you stay out of USA for 1 year (this is assuming that you have already completed 6 years - otherwise, if you have a valid visa, you can enter anytime). I think they will use the I-94 to track your last exit from USA.

NOPE. Your I-94 is all they need. Actually they will have more info on you. Doesn't your passport have any stamps with the exit dates?

Yes, I94 is the base for the entry and exit calculations.
US immigration don't put any mark/stamp on passport while coming out of US.

While applying for new H1, one need to provide I94 entry and exit dates.
Based on number of days stay in US, INS will issue new H1.

There used to be (2006) an ATM in Seattle airport to mark the exit date electronically. I believe, it was not successful, they would have removed it now.

Also, as per IRS, one need to send some document to inform them that one is no more in US and hence one is free from filing taxes. But no one follows, since people make visits very often and it is difficult to inform them every time.
