We recently r2ied i april 2010. My husband went to mumbai for custom clearance of our shipment which is basiclly 10 boxes full with all household items which are used - china placesettings purchased in 2004, daily kitchen items, books dvds used. When we shipped our agent - sky2c told us that its a very straightforward shipment so wont have to pay anything except some octroi taxes. But today when my husband went there they told him to pay Rs. 6000 for the china. when he refused they have asked him to come tomorrow again and meet senior officer. I looked up the list of items under TR and no where it says that you have to pay for household items. we donot have anything else no electronics etc..
We also do not have thereceipt for this china but we had used the original boxes that it came in and it does have the date on theose boxes. could that be used as a proof? it was shipped from Noritake factory outlet.

if the china is considered new by the customs officer, then he has the right to charge you 35% duty because under TR only old and used items are duty free. If you are not claiming TR or are not eligible, then also 35% duty applies. I see no other reason or situation in which the customs will ask for duty on the china. Hope this helps.
