Couple of general questions

Hi,

I am a US citizen and I am relocating to India for an extended period of time. I have a couple of questions that I need clarifications for.

1. I am assuming that I can use TR since I have been in the US for over 15-years.
2. Since there is an outside chance that I may come back to the US in the distant future, is TR the approach to ship all my personal effects?
3. I have a motorcycle that I plan to take to India. Unfortunately, I purchased the vehicle this year and due to my mother's death my relocation has been fasttracked and I wanted to know if importing the bike is going to be a problem. What is the way out if there is a problem importing since I have owned the bike for less than a year?

Please clarify.

You can avail TR on moving to India. This will ensure you are charged minimal duty. Your returning back to US after availing TR should be no problem.
Regarding importing of Motorbike you need to own this bike for atleast a year. If you have not owned for that period you will not be able to import. Assuming you delay your departure and complete one year of ownership, in my view, it is still not worthwhile as duties are pretty high and the landed cost will be astronomically high compared to what you will get here for the similar model/make. In India all major companies are bringing in their best bikes for local sale in India that are considerably cheaper compared to what one would bring here on an individual basis.

1. Yes, TR is the way to ship things duty free
2. Coming back after TR does not affect anything.
3. Motorcycle import rules are stringent. Without one year ownership, you are likely to face a lot of hassles.

Does one avail TR (Transfer of Residence) at the immigration counter upon landing at the airport or at the customs when you clear your shipment?

meelak,

if you are carrying dutiable goods which you wish to clear free of duty on arrival, then you must inform the customs official after you clear immigration and he will give you the required forms. If you do not have any articles with you, you can walk out and fill these forms only when your shipment reaches at the port or arrival.
