Work from India for a US-Company and avoid paying/reporting US Taxes - How?

Post by PlotBuy »

I am an Indian citizen, residing in India since 2008. I was in the US for few years on H1 where I worked, payed taxes etc...

If, being in India, I work or provide services to a US-Company based in US, what will be my tax implications? I understand that I need to pay INDIA-tax on the income as I have been staying here for 2-3 years(>183 day threshold). What about US Taxes? Will/Should my employer deduct taxes at source when he pays me the US$ Salary or "service fee" ? What is the best way to avoid reporting and paying any tax in the US?
Will not being an 'Employee' of the US company and just being a service provider/freelancer individual help the situation of avoiding taxes in the US?

Kindly help.

Best Regards

If you are not an employee of a US company, you don't need to pay US taxes. Some companies may want a declaration from you that none of the work is done from US soil. Even if you are an employee I guess double taxation treaties help you avoid paying US taxes.
