PIO Card Application Question--URGENT

We are planning to R2I to India in December 2010. My husband is already in India. He started his new job there. I am staying back for a couple more months to apply for my infant's PIO card.Once i get it, we will R2I too. I got my infant's passport yday.. i want to apply for PIO card. But the application form says that we need to send both parents' passport along with the application. but since my husband is in india i cannot send it.
can i send an affidavit or something along with the application saying that the father is not in US.
Is ther any other way? please advise.

I would recommend you to call the Indian consulate in NY and check with them.
