Not able to decide to R2A: Please suggest!!!

Hi,

I returned from US in 2008; was there with my family for above 3 years. The decision to return to India in 2008 happened all of a sudden. I have been an emotional personal. Currently I am working with Indian MNC for last 4.5 years and have an L Visa which will be expiring in a year.

I have an opportunity to return to States but I am not firm whether I should return to US or not. One day I feel like going back and next day the feeling is not same.

Below is my family situation:

1. My wife is a housewife. I have a 13 year old kid in class 7th (Will move to 8th from next session)
2. My Parents live in Roorkee; my father is 79. My younger brother (Married) lives with my parents.
3. I live in Delhi with my family in a rented accommodation.

My main motivation to go back to States is:
1. Better life quality.
2. Less population and pollution.
3. Organized life; no chaos like India
4. Opportunities

Sometimes when I further analyze myself it feels that my mind (logic) wants me to go back but heart is somewhere in India itself ( A sense of belonging).

I am not firm in my decision of returning to US; have associated fears as well even though I know I have seen the life there.

1. Fear of how my kid will cope up with new environment.
2. If I go to US at this time; I wont come back. There wont be any returning back bcs of my kid.
3. Feeling of leaving India forever. A sense of loneliness.

Please advise based on your experience or third person's perspective. What should be my approach to deal with this situation.

The critical issue seems to be whether or not your younger brother could get a good match for a marriage.

I suggest don't make any big moves until you have a firm decision. Looks like you haven't made it yet. Until then, stay put and status quo.

All the above 3 are addressable. Kid will be fine in US environment, you can make multiple trips to India and once kid settles you can split time between US and India. You can never leave India, it will stay in your heart.

you were on visa and worked/lived in usa in past for few years right. Now again you want to come on Visa(L1) right? what is your GC chances. can your future/current employer can file in EB1, if yes then it will be good otherwise staying on VISA in USA in current IT market with family (single income) is tough. waiting for GC from decades is waste. people who has GC, then they can decide whether they have to R2I or R2A anytime but for VISA (L1, H1, ...) people it is hard to take the step, you can always go back to india anytime but coming to USA is tougher for visa people.
i am on H1B and i am in dilemma to R2i or not because once i take the decision to go back it will be very harder to come back on visa in future in case if i regret, these days H1B system is Lottery system so chances are less. it's completely up to you to come to USA on Visa and maintain family and wait for GC for decades and no job change flexibility once your GC process is started. you can come and see few years and if you don't like in future then you can always go back to india. Never set your mind that you don't want to return to india forever once after coming/settled in usa, situations can make you return to india anytime since it is home country and it will always welcome you when you have any troubles in your settled foreign country.

Yes my current employer can file for GC.

He already has. Don't go by 2nd hand experience. There are people that can live in harmony.

under EB1 category? Except EB1, all other categories (EB2, EB3) take decades to get GC.

If your compensation in India > 25 lacs and your compensation in USA will be less than 75k, you will be trading down big time. Not recommended.

For a single income visa holder compensation should be around 100k to be able to live a good quality life and still save some money. Make it 120k for bay area and NYC. For small town like Baton Rouge, LA or Birmingham, AL etc.. 85k is sufficient.

If your kid is USC, then he/she will return to US anyway. Plus US kids have to pay more for UG/PG education in India compared to Indian kids. Take that into consideration too. BTW, what do your wife/kid/parents feel?

You will really get mix responses depending on the member. If member wants to R2I, s/he will suggest you to stay back and another member will suggest you to leave India if s/he is truly happy in USA.

What was your real reason to go back to India?
Is that reason not valid now?

Personally I would say don't do it since according to your post you are emotional person.
