Tax: Contracting for an UK client remotely from USA, through an UK-ltd company

Post by spbos »

Hi all,

I will appreciate your answer to my questions below.

Let us assume that I am living in the USA on a H4 EAD since Aug, 2015 and work from home remotely for an UK client through my own one- person limited company in the UK. The contract is between my UK Company and my UK client and the revenue goes to my company bank account in London. My company pays corporation tax on its revenue in the UK.

I was a non-resident in the USA last year. I have not taken any salary or dividends from my UK company during my stay in the USA. What are my tax obligations this year? I had been to H&R-block and they say - as I did not have any income during my stay here last year, I do not owe any tax in the USA. It does not sound quite right to me though?.

What would happen in 2016 as I am going to be a resident in the USA? Can I legally continue with the above arrangement (work remotely from USA for an UK client through my UK limited company? )? If I do not take any dividend or salary at all from my UK Company, will I be liable for any tax here in the USA? What would happen if I want some distribution from my company (through, salary or dividend? ).

I have been trying to find a tax / accounting professional to discuss this, however, no luck so far.

Thank you.
